Specific Terms and Conditions of Sale for private customers
The present conditions of sale are concluded on the one hand by the company whose head office is in Mâcon, registered with the register of the trade and the companies of MACON under the Siren number 841 353 303 here after called “ZUNIK” and on the other hand, by any natural or legal person wishing to make a purchase via the “ZUNIK” website, hereinafter referred to as “the buyer”.
1. Object :
These terms of sale are intended to define the contractual relationship between ZUNIK and the buyer and the conditions applicable to any purchase made through the ZUNIK merchant site, whether the buyer is professional or consumer.
The acquisition of a product through the present site implies an unconditional acceptance by the purchaser of these conditions of sale.
These conditions of sale shall prevail over any other general or special conditions not expressly approved by ZUNIK.
ZUNIK reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
2 – Characteristics and availability of the proposed products:
Each product is accompanied by a description drawn up by the supplier.
The photographs in the catalog are as faithful as possible but can not ensure a perfect similarity with the product offered, particularly with regard to colors.
If errors have been made in the photographs or descriptions of the supplier, under no circumstances ZUNIK’s liability may be incurred.

Product offers and prices are valid as long as they are visible on the ZUNIK website, while stocks last. Information on the availability of products is provided at the time of placing your order.
In the event of unavailability of product after placing your order, we will notify you by email with acknowledgment of receipt or by phone as soon as possible, by offering you to order another article presented on the site in replacement or cancel your order.
If you choose to cancel your order, you will be refunded immediately if your bank account has been debited.
In case of exhaustion of a product, the site agrees to inform you and to refund you at the latest within a period of fourteen days.
3 – Price:
The prices listed in the catalog are prices inclusive of VAT, taking into account the VAT applicable on the date of the order; any change in the rate may be reflected in the price of the products.
ZUNIK reserves the right to modify its prices at any time, provided however that the price listed in the catalog on the day of the order will be the only one applicable to the buyer.
The prices quoted do not include the costs of order processing, transport and delivery provided that they take place in the geographical areas specified below.
The price indicated in the order confirmation is the final price, expressed all taxes included.
This price includes the price of the products, the costs of handling, preparation, packaging and storage of products.
The invoice corresponding to the order is available in the customer’s personal account.
The company “ZUNIK” keeps a digital copy of each invoice.
4 – Geographical area:
The online sale of the products presented in the site is reserved for buyers who live in Metropolitan France (Corsica, Monaco, Andorra), as well as in overseas departments and territories. We serve the rest of the world.

5 – Orders:
The buyer who wants to buy a product must:

The validation of the order implies acceptance of the entirety of the present General Conditions of Sale.

ZUNIK reserves the right to cancel any order from a customer with whom there is a dispute over the payment of a previous order. 6 – Retraction:
In accordance with Article L.121-20 and following of the Consumer Code, and the Hamon law, the consumer has a period of 14 working days from the delivery of his order to return the product to the seller for exchange or refund without penalty, except for the cost of return.

The benefits of reimbursement are excluded:
Consumables whose packaging has been opened, products that have been used by the customer, in particular all products in contact with water or with the customer himself, for reasons of hygiene.
7 – Methods of payment:
The price charged to the customer is the price indicated on the order confirmation sent by ZUNIK.
Payment is due upon order.
Payments will be made by transfer, Paypal, Check or credit card.
a) Payment by credit card:
Payments by credit card will be made by credit card encrypted and secured by La Banque Postale which uses SSL (Secure Socket Layer) so that the information transmitted is encrypted by software and no third party can read it at during the transport on the network.
The order validated by the customer will be considered effective only when the bank payment centers concerned have given their agreement. In case of refusal of said centers, the order will be automatically canceled and the customer notified by email. In addition, ZUNIK reserves the right to refuse any order from a customer with whom there is a dispute.
b) Payment by check:
For customers resident in France, holders of accounts domiciled in banks located in France, payment by check is accepted. Your order is then reserved for 10 working days. Beyond this deadline, without receiving your check, it will be canceled. The Buyer will mention on the back of the check the number of his order and his name and surname (the absence of affixing this information on the back of the check may lead to processing delays whose liability can not be charged to ZUNIK).
The order will only be processed upon receipt of your check and after validation of the payment.
c) Payment by transfer:
At the conclusion of the order, you will receive a confirmation by email or our bank references. Payment must be received within 8 days, otherwise the order will be canceled.
d) Payment by Paypal:
The customer can pay with his Paypal account if it is offered at the end of the order. PayPal is a secure online payment service that allows you to pay for purchases, receive payments, or send and receive money.
8 – Deliveries:
Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.
Once registered and processed, the order is shipped within 24 hours (from Tuesday to Saturday) by Colissimo or by specialized carrier.
The delivery times are those of our partner (LA POSTE: COLISSIMO D + 2 working days). The risks are the responsibility of the purchaser from the moment the products left the premises of ZUNIK. Always check your parcel on arrival in the presence of the deliveryman. If in doubt about the good condition of your package or contents (damaged packaging, open, crushed, torn, noise suspicious, etc.), open it to check that there is no broken or damaged object . Goods will not be replaced if defects are reported after delivery.
If you notice damaged goods:
. refuse the package, note the reason for your refusal on the carrier’s delivery note and keep a copy,
. then notify ZUNIK within 3 working days, attaching a copy of the delivery note (by email to contact@zunik.fr or by post).
In case of damage during transport, you have a period of two days from delivery to make reservations by registered letter with return receipt from the carrier, in case of missing or damaged.
A copy of the reservations must also be sent to ZUNIK within two days.
Delivery times are only indicative; if they exceed thirty days from the order, the contract of sale may be terminated and the buyer refunded.
It is not possible to pick up products at ZUNIK’s head office, the majority of which is not located at this address.
Delivery is offered from 70 € including all taxes and delivery charges.
9 – Warranty:
All the products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code.
Manufacturers guarantee the products as described on the supplied warranty card and / or as indicated on the manufacturers website.
10 – Return – Exchange – Refund:
In case of non-compliance of a product sold, it may be returned to the seller who will resume, exchange or refund the order.
All claims, requests for exchange or refund must be made within a period of fifteen days from the date of delivery.
Please note that we do not accept cashback returns.
In case of exercise of the right of withdrawal, or if you have not received the right reference, the return of the product can only be accepted for products in perfect condition, in their original condition and packaging, the case unused unused and unworn, with all accessories. In other cases the cost of return will be your responsibility.
11 – Responsibility:
The seller, in the process of selling online, is bound only by an obligation of means; it can not be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, break of the service, or other involuntary problems.
ZUNIK can not be held responsible for the non-performance of the contract concluded, due to the occurrence of an event of force majeure and particularly in case of total or partial strike of the postal services, carriers, and disasters caused by floods or fires .
12 – Archiving – Proof:
ZUNIK will archive the invoices on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized records of ZUNIK will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
13 – Settlement of disputes:
The present conditions of sale on line are subjected to the French law.
ZUNIK can not be held liable for damages of any kind, whether tangible or intangible, which could result from a malfunction or misuse of the products marketed. The same is true for any modifications of the products resulting from the manufacturers. The responsibility of ZUNIK will, in any case, be limited to the amount of the order and can not be blamed for simple errors or omissions that could have remained despite all the precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any action in court, to seek an amicable solution including with the help of a professional association of the branch, a consumer association or any other advice of his choice. It is recalled that the search for the amicable solution does not interrupt the “short delay” of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the discretion of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors its financial commitments to the seller.
The complaints or disputes will always be received with attentive benevolence, the good faith being always presumed in the one who takes the trouble to expose his situations. In case of dispute, the customer will first contact the company to obtain an amicable solution.
If an amicable solution could not be found, jurisdiction is assigned to the competent courts of Toulouse, notwithstanding plurality of defendants or warranty claim.
